CITY OF LAMESATEXAS COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM

The City of Lamesa, Texas will hold a public hearing at 5:30 PM on November 15, 2022 at City Hall, 601 S 1st Street Lamesa, TX 79331. The purpose of this meeting is to receive public input on community needs and discuss all TxCDBG and non-TxCDBG funding opportunities and how those resources could be used to address the identified need. Specific considerations will include the citizen participation plan, the development of local housing and community development needs, the source and amount of TxCDBG funding available, all eligible TxCDBG programs and activities, and the use of past TxCDBG funds. The City encourages citizens to participate in the needs identification and development of TxCDBG applications and to make their views known at this public hearing. Citizens unable to attend this meeting may submit their views and proposals to Betty Conde, City Secretary, at City Hall. Persons with disabilities who wish to attend this meeting should contact City Hall for assistance. Individuals who require auxiliary aids or services for this meeting should contact City Hall before the meeting so that appropriate arrangements can be made. NOTICE IS HEREBY GIVEN that the City Council of the City of Lamesa, Texas (the “City”) will meet at its regular meeting place at 601 S. First Street, Lamesa, Texas 79331 at 5:30 p.m. on the 15th day of November, 2022, which is the time and place tentatively set for the passage of an ordinance and such other action as may be deemed necessary to authorize the issuance of the City’s certificates of obligation, payable from ad valorem taxation and a pledge of surplus revenues of the City’s combined utility system of the City, in the maximum aggregate principal amount of $2,750,000, bearing interest at any rate or rates not to exceed the maximum interest rate now or hereafter authorized by law, as shall be determined within the discretion of the City Council at the time of issuance and maturing over a period of years not to exceed forty (40) years from the date thereof, for the purpose of evidencing the indebtedness of the City (1) to pay contractual obligations to be incurred for the construction of a new land fill on City-owned property and (2) for the payment of contractual obligations for professional services pursuant to Subchapter C of Chapter 271, Texas Local Government Code, as amended.  The estimated combined principal and interest required to pay the Certificates on time and in full is $3,348,436.90.  Such estimate is provided for illustrative purposes only and is based on an assumed interest rate of 3.75%.  Market conditions affecting interest rates vary based on a number of factors beyond the control of the City, and the City cannot and does not guarantee a particular interest rate associated with the Certificates. As of the date of this notice, the aggregate principal amount outstanding of tax-supported debt obligations of the City is $11,806,000, and based on the City’s expectations, as of the date of this notice the combined principal and interest required to pay all of the outstanding tax-supported debt obligations of the City on time and in full is $16,294,966.61.

Citizen Participation & Grievance Procedures Notice (required) The City of Lamesa has adopted complaint and grievance procedures regarding American Rescue Plan Act – Coronavirus Local Fiscal Recovery Fund (ARPA - CLFRF). Citizens may obtain a copy of these written procedures at City Hall, 601 S. 1st Street, Lamesa, TX 79331 between regular business hours. Citizens may also request the procedures be mailed to them by calling City Secretary, at 806-872-2124. These procedures outline the steps for a citizen to follow if s/he wishes to file a complaint or grievance about ARPA-CLFRF activities.  A person who has a complaint or grievance about any services or activities with respect to the ARPA-CLFRF project, may during regular business hours submit such complaint or grievance, in writing to the City Secretary, at 601 S. 1st Street, Lamesa, Texas 79331 or may call 806-872-2124.  The City of Lamesa will make every effort to respond fully to such complaints within fifteen (15) working days where practicable.

Water Line and Sewer Line Replacement

CATEGORICAL EXCLUSION DETERMINATION For Lamesa ARP-CLFRF #     Water line and Sewer Line Replacement, Lamesa, Dawson County, Texas

The City of Lamesa has conducted a review of the proposed water line and sewer line replacements in accordance with local, state and federal laws and authorities. The city has determined that this project is eligible for a categorical exclusion and exempting the project from further environmental review requirements. Neither an Environmental Assessment/Finding of No Significant Impact nor an Environmental Impact Statement will be required for the proposed action. The following is a brief description of the project and a brief statement of how the action meets the criteria for a categorical exclusion.

The water line and sewer line replacements will occur where the current lines are located, along S Bryan Ave from N 4th St to S 3rd. The current structure will be abandoned in place. The city has identified that these lines are of greatest need for immediate replacement. The replacement of these lines will improve service for customers and decrease maintenance for the city. The total project cost is approximately $1,427,150. The proposed funding for the project consists of the American Rescue Plan Act -Funds – Coronavirus Local Fiscal Recovery Funds.

The project is considered Categorically excluded because as it will not adversely impact the environment and does not conflict with any federal, state, local government or federally-recognized Indian Tribe environmental resource-protection, or land-use laws or regulation. The project is compatible with existing land use as it involves replacing existing water and sewer lines. The project will not affect population growth patterns as it will not increase the capacity of the water or sewer lines that are to be replaced. This project will be constructed in previously disturbed ground, specifically ground disturbed by previously installed water and sewer lines. 

Documentation to support this decision will be on file in at City Hall at 601 S 1st St, Lamesa Tx 79331 and is available for public review upon request. Comments may be submitted to Betty Conde, citysecretary@ci.lamesa.tx.us. It is now the city’s intention to utilize funds for construction.

SECTION 00 11 13 - ADVERTISEMENT FOR BIDS

Sealed Bids for construction of the TxCDBG DRP Project Contract #7220182, Sidewalk/Street Improvements in Lamesa, Texas will be received at the office of the city secretary of City of Lamesa, 601 South 1st Street, Lamesa, Texas, 79331 until 4:00 PM local time on March 15, 2022. Proposals will be publicly opened and read aloud at Lamesa City Hall during the March 15, 2022, regular City Council meeting. Any Bid received after closing time will be returned unopened.

The City of Lamesa reserves the right to reject any or all bids or waive any informalities in bidding. Bids may be held by the City of Lamesa not to exceed 60 days from the date of the bid opening to review bids and investigating bidder qualifications before Contract award.

Information for bidders, proposal forms, specifications and plans are on file at City of Lamesa, 601 S 1st Street, Lamesa, Texas 79331, and the office of Parkhill, Consulting Engineers, 4222 85th Street, Lubbock, Texas, 79423.

Attention is called to the fact that not less than, the federally determined prevailing (David-Bacon and Related Acts) wage rate, as issued by the Texas Department of Agriculture Office of Rural Affairs and contained in Contract Documents, must be paid on this project. In addition, the successful bidder must ensure employees and applicants for employment are not discriminated against because of race, color, religion, sex, sexual identity, gender identity, or national origin.

Bidders must submit a Cashier's or Certified Check issued by a bank satisfactory to the Owner, or a Proposal Bond from a reliable Surety Company, payable without recourse to the order of City of Lamesa in an amount not less than five percent (5%) of the bid submitted as a guaranty that the Bidder will enter into a contract and execute bonds in the forms provided within fifteen (15) days after notice of award of contract to him. Bids without the required check or Proposal Bond will not be considered.

All contractors/subcontractors that are debarred, suspended, or otherwise excluded from or ineligible for participation on federal assistance programs, may not undertake any activity in part or in full under this project.

The successful Bidder will be required to furnish a Performance Bond and a Payment Bond, each in the amount of the contract, written by a responsible Surety Company authorized to do business in the State of Texas, and satisfactory to the Owner, as required by Article 5160, V.A.T.C.S., as amended by H.B.344, passed by the 56th Legislature, Regular Session 1959.

Bidders are expected to inspect the site of the work and to inform themselves regarding all local conditions.
